The defamation trial involving Johnny Depp and Amber Heard has entered its final stages.

Depp is suing Heard, his ex-wife, over an article she wrote in The Washington Post in 2018, in which she described herself as a “public figure representing domestic abuse.

However, the trial is not taking place in Washington DC, or indeed Hollywood, as one might expect of two movie stars – here’s why it’s in Virginia instead.

Where is the Johnny Depp trial taking place?

The trial is taking place at Fairfax County Courthouse in Virginia, which was constructed as the seat of the local government in 1799.

Fairfax County is in the suburbs of Washington DC, and is the most populous part of Virginia – it is notable for being home to the headquarters of the CIA.

The Fairfax County Courthouse is the largest trial court in Virginia, and has has authority to try a full range of cases, both civil and criminal, jury and non-jury.

Why is the Johnny Depp trial in Virginia?

The trial is taking place in Virginia because The Washington Post, the paper in which Heard wrote the article Depp claims defamed him, is published there.

According to The Post, which is not a defendant in the case, the newspaper “houses its printing press and online server in Fairfax County”.

When will the Johnny Depp trial end?

The trial started on 11 April and was originally scheduled to conclude on 19 May, but has now been extended and is expected to end on 27 May.

Court has been in session from Mondays to Thursdays, starting at 9am eastern time and finishing at 5pm.

The UK is five hours ahead of Virginia time, which means that proceedings begin at 2pm British Summer Time and finish around 10pm.

Why is Johnny Depp suing Amber Heard?

Depp is suing Heard, his ex-wife, for $50m (£40m) over an article she wrote in The Washington Post in 2018, in which she described herself as a “public figure representing domestic abuse”.

Heard did not name Depp in the article, but he claims it has cost him acting roles.

She has counter sued him for $100m, claiming Depp defamed her when his legal team referred to her claims as “fake” and a “sexual violence hoax”.

The former couple, who were married from 2015 to 2017, both accuse the other of being physically violent during the relationship. They each deny the other’s claims.

Depp and Heard met in 2009, on the set of The Rum Diary, in which they played lovers.

The couple released a joint statement when their divorce was finalised saying: “Our relationship was intensely passionate and at times volatile, but always bound by love.

The actor has also made headlines for calling his fans "relatives" while arriving at the courthouse.

The trial is headed into its final week.

The "Aquaman" actress has testified that Depp sexually and physically abused her — something that Depp has denied throughout his testimony.

Heard has said drugs and alcohol — along with paranoid jealousy — are what turned him from the man she loved into the “monster” who made her fear for her life. She said he hid his drug and alcohol use from her and from his family but his behavior made it clear he was high or drunk, often to the point of incoherence.

Depp, for his part, says he was the victim of the violence. He says his ex-wife berated and attacked him constantly during their short-lived marriage. Depp has said he never physically attacked Heard, and that she routinely hit him and threw things at him through the course of their relationship.

Closing arguments are set for Friday, May 27 and jury deliberations will begin when the closing arguments conclude.

The explosive defamation trial between Johnny Depp and Amber Heard is unfolding well outside their normal Hollywood orbit - at a court in Fairfax County, Virginia.

Mr Depp’s suit against his ex-wife alleges that she defamed him in a December 2018 op-ed published in The Washington Post titled “I spoke up against sexual violence — and faced our culture’s wrath. That has to change”.

The trial is taking place in Fairfax because the online edition of The Post is published via servers in the county, allowing Mr Depp to sue her in that area.

According to the Associated Press, Ms Heard’s attorneys tried to get the trial moved to California but Mr Depp’s lawyers said one of the reasons they decided to sue in Virginia was because of the state’s anti-SLAPP legislation, which is not as wide-ranging as in California.

SLAPP stands for strategic lawsuits against public participation. “Anti-SLAPP laws are meant to provide a remedy to SLAPP suits. Anti-SLAPP laws are intended to prevent people from using courts, and potential threats of a lawsuit, to intimidate people who are exercising their First Amendment rights,” according to the Reporters Committee.

In her 2018 op-ed, Ms Heard partly wrote that “like many women, I had been harassed and sexually assaulted by the time I was of college age. But I kept quiet — I did not expect filing complaints to bring justice. And I didn’t see myself as a victim”.

“Then two years ago, I became a public figure representing domestic abuse, and I felt the full force of our culture’s wrath for women who speak out,” she added at the time.

While Mr Depp isn’t named in the piece, his legal team argues that it contains a “clear implication that Mr Depp is a domestic abuser”, which they say is “categorically and demonstrably false”. Mr Depp is seeking damages of “not less than $50m”.

Ms Heard has filed a $100m counterclaim against Mr Depp for nuisance and immunity from his allegations.
