Actress Ellen Barkin will be called to testify on Amber Heard's behalf once the defamation trial resumes in Fairfax County, Va. on May 16.
Heard is being sued for $50 million by ex-husband Johnny Depp over her 2018 Washington Post op-ed chronicling her experiences as a domestic violence survivor. Though Heard never mentions Depp by name, his lawyers argue that references to their client (and Heard's previous abuse allegations following their 2017 divorce) are clear. The op-ed, Depp's team claim, has damaged the actor's career and reputation.
Heard filed a $100 million countersuit, claiming Depp and his legal team defamed her by calling her allegations false. After Depp's four days behind the stand, Heard began her testimony last week and will resume Monday. Next week, Heard's sister, Whitney, will take the stand, as well as Barkin. The Drop Dead Gorgeous star joins a roster of celebrities featured in Heard's witness list, including former costar James Franco and ex-boyfriend Elon Musk. Those two, however, aren't expected to testify.

But what is Barkin's connection to the defamation suit?
Barkin had a brief relationship with Depp in the 1990s. They met while working on the 1998 film Fear and Loathing in Las Vegas. Barkin previously testified in Depp's libel lawsuit against The Sun, wherein the actor took the British newspaper to court over their use of the term "wife beater" in an article centered on Heard's abuse allegations. (The actor lost the lawsuit.) Barkin accused Depp of being verbally abusive during the course of their relationship, also alleging that he once threw a wine bottle across a hotel room during an argument with friends.
The actress testified that Depp was never physically abusive towards her, but maintained that he had bouts of violence. In court in London, Depp testified that Barkin called him abusive because she held a "grudge" against him. "A sexual element began with Ms. Barkin which lasted for months on and off really because she was making the film I was making at the time, Fear and Loathing in Las Vegas," Depp said, according to Daily Mail. "She wanted a proper relationship with me and I did not want that. I didn't feel the same about her as she did me and I suppose from that moment on she became very, very angry and since then I have not spoken to Ms. Barkin."

As for Depp and Heard, the two have accused each other of abuse in their respective testimonies. Depp has already completed his time behind the stand, but is expected to retake it once the trial resumes Monday. Closing arguments will be on Friday, May 27. "If jurors conclude that this was a mutually abusive relationship, some may see [Heard's op-ed] as technically correct," Dr. Jill Huntley Taylor, a legal analyst and the CEO of Taylor Trial Consulting, a trial strategy and jury consulting firm for civil and criminal cases, previously told EW of a possible outcome.
"However, other jurors may believe what [Heard] wrote was only a half-truth, and therefore deceptive," Taylor said. "The testimony that she [initially] wanted his name included [in the op-ed] may suggest malice, but the timing prior to her movie release may suggest her real motive was to benefit herself." No matter who wins, though, "There are truly no winners," Taylor said. "This is a case of a toxic relationship, and no one is coming out of it unscathed, regardless of whether monies change hands."Related content:

Amber Heard's team is expected to call actress Ellen Barkin as a defense witness in her ex-husband Johnny Depp's defamation case against Heard, a source close to Heard's camp told Fox News Digital.
Barkin, 68, briefly dated Depp, 58, back in 1997 while they filmed "Fear and Loathing in Las Vegas."

It isn't the first time Barkin has spoken out about their relationship which ended badly.

Barkin, who Depp's camp has dismissed as a disgruntled former lover, is expected to testify via video at the Fairfax County Circuit Courthouse in Virginia. She has become friendly with Heard.
The "Ocean's Thirteen" actress was the fourth wife of billionaire financier Ron Perelman – but the two had a nasty split, with him accusing her of misappropriating funds during their divorce.
Heard's defense case began last week. The 36-year-old took the stand, sobbing as she described alleged physical and sexual abuse at the hands of Depp – including a claim he raped her with a liquor bottle in 2015 in Australia.

The trial went dark this week for a pre-scheduled break with Depp jetting off to England, according to a fan who posted a picture with the actor on Twitter under the caption "Spotted in Newhaven, East Sussex yesterday, #JohnnyDepp."

Heard is back in the witness box Monday. Once her testimony wraps up, her lawyers, Elaine Bredehoft and Ben Rottenborn, will call Barkin, Heard's sister Whitney Henriquez and Depp – but not necessarily in that order.

Although Depp already spent four days testifying, his ex-wife's turn on the stand has opened the door for her team to question him on issues they weren't permitted to broach during his cross-examination, the Heard source said.
Henriquez lived in one of Depp's Los Angeles penthouses and testified in the UK trial that she saw bruising on her sister's face early in the couple's relationship.
The two potential defense witnesses that had garnered the most attention will not be in the courtroom: actors James Franco and Tesla CEO Elon Musk, according to the Heard source.

Actress Ellen Barkin is being asked to testify on behalf of Amber Heard’s legal team in the current trial with Johnny Depp, but it’s not the first time she’s been called as a witness to discuss Depp.
Having worked with Depp on the 1998 movie Fear and Loathing in Las Vegas and had a brief relationship with him, Barkin’s testimony was also used in the 2020 trial involving Depp and News Group Newspapers Ltd, the publishers of the British tabloid The Sun. The current trial is taking place because Depp is suing Heard for $50 million in defamation damages after she wrote a 2018 op-ed stating she was the victim of domestic abuse. Heard has counter-sued for $100 million.
Barkin has spoken openly about her relationship with Depp in the past and is expected to give a video deposition in the next week. Depp is also set to be called back to testify once again.
Comments on Johnny Depp’s character
Barkin and Depp are said to have been involved in a brief relationship in 1997 whilst filming Fear and Loathing in Las Vegas. Speaking about her experience with Depp, she said: “There is always an air of violence around him.”
The comments are listed in the case notes for the 2020 Depp v News Group Newspapers Ltd trial, which Depp ultimately lost. “There was just this world of violence…He is a yeller. He is verbally abusive,” Barkin said.
Depp was asked in court why Barkin testified against him, to which he suggested it was because she wanted more than the “sexual element” that lasted between the pair for months, on and off. “She wanted a proper relationship with me and I did not want that,” Depp said. “I didn’t feel the same about her as she did me and I suppose from that moment on she became very, very angry.”
Wine Bottle Incident
A U.S. deposition highlighted within the 2020 trial brought up the wine bottle incident. It has been mentioned many times that during his relationship with Barkin, Depp threw a wine bottle in a hotel room.
Twitter user @mimasdiaries highlighted the key details from a transcript from the 2020 trial.
In the testimony, Barkin once again accused Depp of “a lot of yelling” before discussing the wine bottle incident. “Yes, Mr. Depp threw a wine bottle across the room, the hotel room, in one instance, in Las Vegas, while we were shooting Fear and Loathing in Las Vegas,” she reportedly said.
She went on to confirm that the bottle didn’t hit her or anyone else.
Barkin was also asked if Depp had ever hit her, “No, he did not,” she said. Barkin also confirmed that he never kicked her or physically assaulted her in any way either.
On Twitter in February 2021, Barkin brought up Depp’s name again at a time when his friend Marilyn Manson was being accused of sexual assault and abuse.
Who is Ellen Barkin?
Barkin is a 68-year-old Primetime Emmy Award winning actor who has been appearing on our screens since the 1970s. She won an Emmy for the 1997 TV movie Before Women Had Wings but is also famous for appearing in Drop Dead Gorgeous, The Fan and TV series Animal Kingdom.
She was married to actor Gabriel Byrne (The Usual Suspects) with whom she has two children. The couple wed in 1988 but separated in 1993 before finalizing their divorce in 1999. She later married businessman Ronald Perelman in 2000 but they divorced in 2006.
From 2008 to 2011 she dated filmmaker Sam Levinson, with whom there was a 31-year- age difference. Barkin had worked with Sam’s father Barry Levinson in the 1982 movie Diner, three years before Sam was born.
